These Terms of Service (“Terms”) govern your use of the REVIVAL ATHLETIC website and any products, services, coaching, memberships, digital products, downloadable training programmes, content, community features or other services provided by REVIVAL ATHLETIC, also operating under the names REVIVAL and REVIVAL TRAINING CLUB (“we”, “us”, “our”).

By accessing our website, purchasing products, purchasing or accessing digital training programmes, engaging coaching services, joining our community or otherwise using our services, you agree to be bound by these Terms and any other applicable policies or terms published on our website.

These may include our Privacy Policy, Returns & Refunds Policy, Shipping Policy, Cookie Policy and any product-specific or service-specific terms.

If you do not agree to these Terms, you must not use our website, products or services.

ELIGIBILITY

By using our website or purchasing our products or services, you confirm that:

MADE-TO-ORDER PRODUCTS

Certain physical products may be manufactured, printed, embroidered or otherwise produced following purchase.

Production times may vary and estimated dispatch times are provided for guidance unless expressly guaranteed.

Made-to-order products remain subject to applicable statutory consumer rights.

Any restriction on cancellation rights for personalised or bespoke products will apply only where permitted by law.

PRICING

Prices are displayed in Pounds Sterling (£ GBP) unless otherwise stated.

We may change prices for future purchases at any time.

Price changes will not normally affect an order that has already been accepted unless required or permitted by law.

If an obvious pricing error occurs, we may contact you before accepting the order and give you the opportunity to purchase at the correct price or cancel the order.

Where payment has already been taken for an order that we subsequently lawfully cancel, an appropriate refund will be issued.

ORDERS

All orders are subject to acceptance.

Submitting an order does not necessarily mean that we have accepted it.

We may refuse or cancel an order where reasonably necessary, including where:

• Fraud or unauthorised activity is reasonably suspected
• Payment cannot be authorised or verified
• A product is unavailable
• An obvious pricing or product-description error has occurred
• Applicable purchase restrictions have been breached
• We are legally prohibited from fulfilling the order

Where we cancel an order after payment has been taken and no goods or services have been supplied, an appropriate refund will be issued.

PAYMENT

Payment must normally be received in full before goods, digital content or services are supplied unless otherwise agreed.

Payments may be processed through third-party payment providers.

Your use of a third-party payment provider may also be subject to that provider's terms and privacy practices.

SHIPPING AND DELIVERY

Shipping information for physical products is provided separately in our Shipping Policy.

Delivery dates and times are estimates unless expressly guaranteed.

We are not responsible for delays caused by circumstances genuinely outside our reasonable control.

Where applicable consumer law gives you rights relating to delayed or failed delivery, those rights remain unaffected.

Risk in physical goods passes to you in accordance with applicable consumer law.

RETURNS, REFUNDS AND CANCELLATIONS

Returns, exchanges, cancellations and refunds are governed by our Returns & Refunds Policy and applicable consumer law.

Different cancellation rules may apply to physical goods, services and digital content.

Nothing in these Terms affects your statutory consumer rights.

DIGITAL TRAINING PROGRAMMES AND PRODUCTS

REVIVAL ATHLETIC may sell downloadable or electronically accessible fitness and training products including:

• Strength programmes
• Speed programmes
• Hybrid and athletic-performance programmes
• Conditioning programmes
• Exercise programmes
• Training schedules
• Exercise guides
• Educational training resources
• Other downloadable or digital fitness content

Unless expressly stated otherwise, these products provide general training and educational information and are not individually prescribed medical, physiotherapy or healthcare services.

A general downloadable programme is not personalised to your individual medical history, injuries, physical limitations, health status or personal circumstances unless expressly sold as a personalised service.

DIGITAL CONTENT DELIVERY AND CANCELLATION

Digital content may be supplied or made available for access immediately following purchase.

Where required by applicable law, you may be asked to expressly consent to digital supply beginning during the statutory cancellation period and acknowledge that your right to cancel will be lost once supply begins.

Refund and cancellation rights for digital content are explained further in our Returns & Refunds Policy.

Nothing in these Terms removes rights relating to digital content that is faulty, misdescribed or otherwise fails to conform to applicable consumer law.

DIGITAL PRODUCT LICENCE

Unless expressly stated otherwise, purchasing a digital product grants you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to use the purchased content for your own personal, non-commercial use.

Purchasing digital content does not transfer ownership of our intellectual property to you.

You must not, without our prior written permission:

• Share purchased programme files with another person
• Upload programmes to file-sharing services or public websites
• Reproduce or distribute programme content
• Resell a programme
• Give purchased programmes to clients, customers, teams or organisations
• Modify and redistribute our content
• Use our programmes to create competing commercial products or services
• Remove copyright, trademark or ownership notices
• Publish screenshots, substantial extracts or copies of paid content
• Make paid content publicly available

We reserve the right to take reasonable action in response to unauthorised distribution or infringement of our intellectual property rights.

IMPORTANT HEALTH AND EXERCISE INFORMATION

Physical exercise involves inherent risks.

These risks can include, among other things:

• Muscular soreness
• Strains and sprains
• Falls
• Joint or soft-tissue injuries
• Aggravation of existing injuries or medical conditions
• Cardiovascular stress
• Accidents involving exercise equipment
• Serious injury or, in rare circumstances, death

You acknowledge that no exercise programme can eliminate all risks associated with physical activity.

YOUR RESPONSIBILITY BEFORE EXERCISING

You are responsible for determining whether you are physically capable of participating safely in any exercise or training programme.

Before beginning a programme, you should seek appropriate medical or healthcare advice where you:

• Have an existing medical condition
• Have a current or previous injury that may affect exercise
• Are pregnant or have recently given birth
• Take medication that may affect exercise
• Have been advised to restrict physical activity
• Experience symptoms that may make exercise unsafe
• Are uncertain whether a programme is appropriate for you

Our general digital programmes are not a substitute for assessment, diagnosis, treatment or advice from an appropriately qualified healthcare professional.

You should not disregard professional medical advice because of information contained in one of our programmes or on our website.

RESPONSIBILITY WHILE TRAINING

When using our programmes or fitness content, you are responsible for exercising within your own capabilities.

You are responsible for:

• Selecting appropriate weights and resistance
• Selecting appropriate exercise intensity
• Using suitable equipment
• Ensuring equipment is correctly set up and maintained
• Training in a reasonably safe environment
• Using appropriate exercise technique
• Following relevant safety instructions
• Allowing appropriate recovery
• Adjusting or stopping activity where necessary
• Seeking qualified assistance when you do not know how to perform an exercise safely

You should stop exercising and seek appropriate assistance if you experience symptoms such as severe or unusual pain, fainting, chest pain, severe dizziness, significant breathing difficulty or other concerning symptoms.

Do not attempt an exercise you do not understand or cannot perform safely.

ASSUMPTION OF INHERENT RISK

By voluntarily participating in physical activity using our programmes, you acknowledge and accept the inherent risks ordinarily associated with exercise and physical training.

You remain responsible for your own decisions regarding participation, exercise selection, resistance, intensity, technique, equipment and training environment.

REVIVAL ATHLETIC cannot remotely supervise the use of a general downloadable programme and cannot verify your:

• Health or medical status
• Exercise technique
• Equipment
• Training environment
• Exercise intensity
• Selected weights or resistance
• Compliance with programme instructions
• Modifications made to the programme

To the fullest extent permitted by law, we will not be responsible for injury, loss or damage caused by your misuse of a programme, failure to follow reasonable safety instructions, use of unsuitable equipment, unsafe exercise technique, inappropriate modification of a programme or participation beyond your known capabilities.

Nothing in these Terms excludes or restricts liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

NO MEDICAL SERVICES

Unless expressly stated otherwise, REVIVAL ATHLETIC does not provide medical diagnosis, medical treatment, physiotherapy or other regulated healthcare services through the sale of general downloadable training programmes.

Information relating to exercise, recovery, fitness, performance or nutrition is provided for general educational purposes unless expressly included as part of a separately agreed professional service.

If you require medical advice, diagnosis or treatment, you should consult an appropriately qualified healthcare professional.

RESULTS DISCLAIMER

Individual results vary.

We do not guarantee:

• Weight loss
• Fat loss
• Muscle gain
• Strength increases
• Improvements in speed
• Improvements in endurance
• Changes in body composition
• Improvements in sporting or athletic performance
• Prevention of injury
• Any particular physical, aesthetic or performance result

Results depend on numerous factors outside our control, including individual physiology, genetics, previous training experience, nutrition, sleep, recovery, consistency, effort, technique, lifestyle and adherence.

Testimonials, transformations, examples and performance outcomes relating to other individuals do not guarantee that you will achieve the same results.

COACHING SERVICES

Where personalised coaching services are provided, additional terms, questionnaires, agreements, informed-consent documents or waivers may apply.

Coaching is intended to provide fitness, training and educational support within the scope of the service being offered.

Unless expressly stated otherwise:

• Coaching does not constitute medical diagnosis or treatment
• Results cannot be guaranteed
• Progress depends substantially on individual circumstances and adherence
• You remain responsible for accurately disclosing information relevant to safe participation
• You must notify us of relevant changes to your circumstances where appropriate
• You remain responsible for seeking medical or healthcare advice when required

A coach's ability to provide appropriate guidance depends partly on the accuracy and completeness of the information supplied by you.

NUTRITION INFORMATION

Where general nutrition information is provided, it is intended for general educational purposes and should not be treated as medical or dietetic treatment.

Individual dietary requirements can vary significantly.

Where you have a medical condition, allergy, intolerance, eating disorder, prescribed dietary requirement or other circumstance requiring specialist nutritional advice, you should consult an appropriately qualified healthcare or nutrition professional.

COMMUNITY MEMBERSHIPS

Where access to a community, membership, group, forum or online platform is provided, you agree to behave lawfully and respectfully.

You must not engage in:

• Harassment
• Threatening or abusive behaviour
• Discrimination
• Illegal activity
• Deliberate disruption
• Fraud
• Unauthorised commercial promotion
• Conduct that materially threatens the safety or legitimate interests of other members

We may suspend or remove access where there is a reasonable basis for doing so because of serious or repeated breaches of these requirements.

Any entitlement to a refund following suspension or termination will be determined in accordance with applicable law and the terms governing the relevant membership.

USER-GENERATED CONTENT

If you submit reviews, photographs, videos, comments, testimonials or other content to us, you confirm that you own the content or otherwise have the rights and permissions necessary to submit it.

Where you expressly submit content for publication, promotion or use by REVIVAL ATHLETIC, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for the purposes for which it was submitted, subject to applicable law and our Privacy Policy.

We will not rely on this provision to use private coaching information, private photographs or sensitive personal information publicly where separate consent is legally required.

INTELLECTUAL PROPERTY

Unless otherwise stated, intellectual property rights in our website, branding, materials and content belong to us or our licensors.

This may include rights relating to:

• Logos and brand marks

Where you are purchasing as a consumer, we supply our products and services for private use unless expressly agreed otherwise. We are not responsible for business losses arising from consumer use, including loss of profits, revenue or business opportunities, to the extent permitted by law.

We do not seek to exclude liability for losses caused by our failure to exercise reasonable care and skill or for other matters for which liability cannot legally be excluded.

FORCE MAJEURE

We will not be responsible for failure or delay in performing contractual obligations where the failure or delay results from circumstances genuinely outside our reasonable control.

Changes will not retrospectively remove contractual or statutory rights that have already arisen.
